In order to offer and manage the services described in the agreement to you for letting you operate as an affiliate of our program, we need certain personal data. Therefore, and in compliance with EU Regulation 2016/679 of the European Parliament and of the Council, of April 27, 2016 (General Data Protection Regulation) we believe it is important that affiliates know -or can easily know and of course – what data we must obtain, what we use them for and how they can control the treatment we make of them through the exercise of their rights.

1 – Legal basis for the processing of your data

The legal basis for the processing of your data is the express and unequivocal consent that you give us by accepting this document when filling out the registration form. For this purpose you can find in this document detailed information of the personal data we process.

As required by the GDPR, however, we will not ask you in any case for more information than necessary or use them for purposes other than those that led you to share them with us.

Below we detail the data that we will ask you at all times and for what purpose, as clearly as possible.

3. Department of Personal Data Processing

Amateur.cash undertakes to store and process personal data in accordance with the General Data Protection Regulation, and for this purpose it has a Department of Personal Data Processing ( [email protected] ), responsible for ensuring compliance with the law and thus guaranteeing the security of the data. This department and its actions are supervised by our Data Protection Delegate .

Only members of the Department of Personal Data Processing may access the personal data of users and issuers in order to be able to collect, store, consult, modify or delete them.

4. Data retention mode

Personal data is restricted access only to the staff of the Department of Personal Data Processing, and is stored in a database with access log, pseudonomized (with the user nickname) and fully encrypted.

On the other hand, as mentioned in the following section, the blocked data will be stored in another database with access log, pseudonomized and fully encrypted, being able to access them only in case of judicial requirement.

5. Term of data retention

The current legislation does not contemplate data retention periods once the right of deletion is exercised or when its blocking is required, but it establishes that it should not be extended more than is necessary to face possible responsibilities arising from the contractual relationship . For this, the policy of Amateur.cash will always be to keep personal data for a period of 5 (five) years from the date of exercise of the right of deletion by the user or issuer in question.

During this time, however, personal data will be migrated to another fully encrypted database and blocked by the best technology that can be applied at any time, not being accessible to any VTS Media Inc worker or third parties – except judicial requirements .

6. Rights of users and issuers regarding their personal data («ARCO rights»)

Any user or issuer, by the mere fact of being it and having shared with us any type of personal data, has the following rights under the General Data Protection Regulation:

  • Right of access: Right to access your personal data, that is, to know what data you have Amateur.tv. We will respond in a maximum of 30 calendar days from the receipt of your request.
  • Right of rectification: Right to request the rectification of your personal data when they are inaccurate. We will respond within 10 business days of receiving the request.
  • Right to object : Right to object to the processing of your personal data. We will respond within 10 business days of receiving the request.
  • Right of deletion: Right to obtain the deletion of your personal data without undue delay. As explained in sections 4 and 5 of this document, the data will be deleted 5 years after the date of the exercise of the right, keeping until then blocked. We will respond within 10 business days of receiving the request.
  • Right to data portability: Right to receive your personal data in a format that allows its transmission to another data controller. We will respond within 10 business days of receiving the request.

To exercise these rights, it will be necessary to send an email to the address specified in section 3 of this document ( [email protected] ) clearly, unequivocally and concisely specifying the request you wish to make. Then you will be asked for the minimum essential information for your identification.

In the event that the mail is not intelligible, clarification will be requested as soon as possible, and the deadlines cited at this same point to respond to the request will not be understood.

7. International data transfers

Amateur.cash undertakes not to share any information with third parties -except judicial requirement-, except for the name, surname and collection account in cases of users wishing to collect commissions.

In these cases, since the payments will be made by the payment provider at the user’s choice, it will be necessary that the name and surname of the issuer appear in the field of beneficiary of the transfer or similar. It will also be imperative to share with the payment provider the account where it will have to be made, the result of the logical procedure of data transfer. These data must therefore necessarily pass through the provider responsible for processing the payment.
